CATHEDRAL BEACH TERMS & CONDITIONS

Proprietor

Cathedral Beach Pty Ltd ACN 608 720 823 as trustee for the Cathedral Beach Unit Trust (‘Cathedral Beach’) is the proprietor and lessee of the Cathedrals on Fraser campground (“campground”).

Check-in

Reception hours are 8am to 5pm AEST (6pm during peak times). Hours may vary.

Check-in is from 2pm to 5pm (2pm to 6pm during peak times). Please contact Reception during working hours on 07 41279177 to make arrangements if arriving after these hours.

Check-out must be effected prior to 10am AEST unless prior arrangements have been made with Cathedral Beach.

Accommodation facilities

Cathedral Beach offers:

  1. Unpowered sites;
  2. Powered sites;
  3. Permanent tents; and
  4. Cabins & Villas

Hereinafter, any reference to a site shall be a reference to all or any of the cabin sites, permanent tent sites, powered sites or unpowered sites.

Cathedral Beach’s acceptance of your reservation shall, in relation to sites, constitute the granting of a camping permit in relation thereto.

Cabins

A “key deposit” of $50 is payable when checking in. The key deposit will be refunded upon return of the key.

Cabins have bed linen, bath towels and tea towels provided. Beach towels are not included.

Permanent tents

Permanent tents have beds, indoor lighting and an outdoor power point (limited to 4amps). Bed linen can be provided for an additional cost.

Booking Conditions

Site fee for powered and unpowered sites covers first two persons. Each additional person will incur an additional fee.

Maximum people permitted per site, except for “premium powered” sites, is 6, not including infants. Maximum of 1 vehicle with trailer/camper or 2 vehicles with tents/swags.

Maximum people permitted per “premium powered” site is 10, not including infants. Maximum of 2 vehicles with small trailers/campers.

A “premium powered” site is extra-large, with a private undercover picnic table, fire-ring and clothesline, and no immediate neighbours.

A camping permit is granted for a maximum of 30 days. Failing to comply with permit conditions may result in the booking being terminated.

All persons under the age of 18 years must be accompanied by a responsible adult (see clause on unaccompanied minors below).

All fees and charges are in Australian dollars and are subject to change without notice.

High Season

Those periods corresponding to all Queensland and New South Wales school holidays. Dates may change annually.

Off-peak periods

All periods that are not peak periods.

Payment of booking fee

You must pay 50% of your booking fee at the time of making your booking. The balance of 50% must be paid, in the case of bookings for accommodation during high season, and all group bookings, a minimum of 60 days prior to arrival, and in the case of bookings for accommodation during low season, a minimum of 14 days prior to arrival. Alternatively, you may pay the full booking amount at the time of booking to secure your site or cabin.

Cathedral Beach accepts credit card payments by Visa Card or Mastercard only.

Cathedral Beach does not accept payment by American Express cards or Diners Club cards.

By making your booking you authorise and grant the right to Cathedral Beach to charge your credit card for any damages suffered by Cathedral Beach as a result of your direct or indirect deliberate or negligent actions or inactions, late check-out fees, loss suffered as a result of the misuse of Cathedral Beach property caused by you or people for whom you are responsible or the presence of ‘extra’ people on your site the presence of whom had not been notified or authorised.

Changes to Bookings

Any changes to your booking will incur a minimum $20 per site administration fee increasable at the discretion of Cathedral Beach, to a maximum of $50 per site, which fees are subject to review from time to time.

Bookings may be altered subject to availability, and by giving 14 days’ notice in low season, and 60 days’ notice for group bookings and in high season. If you have booked within 14 days of your arrival, 24 hours’ notice will need to be given to make any changes. You may change your booking to another date, if available, by contacting us.

You may change a booking to decrease the number of nights by giving 14 days’ notice in low season, and 60 days’ notice for group bookings and in high season; however, if you do so, you will not be entitled to a refund. You will receive a refund for the balance, less a $20 administration fee.

If you do not give 14 days’ notice in low season, and 60 days’ notice for group bookings and in high season, or 24 hours if booked within 14 days of your stay, we will not be able to offer a refund or credit.

Cancellations

You may cancel your booking by contacting Cathedral Beach at least 14 days’ notice in low season, and 60 days’ notice for group bookings and in high season, or 24 hours before your arrival if booked within 14 days of your stay. You will be offered an accommodation-only credit for use within 12 months from the first day of your booking (minus a $20 administration fee) or a refund (minus a $50 cancellation fee). Should you not use your credit by the end of the 12-month period, it will be forfeited to Cathedral Beach.

If you do not give 14 days’ notice in low season, and 60 days’ notice for group bookings and in high season, or 24 hours if booked within 14 days of your stay, we will not be able to offer a refund or credit.

Request to extend cabin occupancy or camping period

A request to extend your camping period or cabin occupation period made immediately before or during your stay will be considered where possible.

You may request to extend your booking by contacting Cathedral Beach at Reception.

Extreme Situations

In the event that access to the campground is prevented by weather extremes or emergency situations, or if facilities are closed for all or part of the camping permit period, we will at no additional cost, offer alternative camping for the period so prevented or the unused balance of your stay, within the next 12 months from the first day of your booking.

Refunds

In the unlikely event that Cathedral Beach is unable to provide a site or cabin on the date listed on your confirmation document, you will be offered an alternative site or cabin, or alternate dates. If no suitable arrangements for alternate sites, accommodation or dates can be made, you may be offered a full or part refund in recognition of the change to your booking.

Cathedral Beach will reject a claim for a refund based on circumstances outside of its control including:

  • Unfavourable or unpleasant weather conditions before or during the stay.
  • Personal decisions to change travel plans.
  • Personal decisions to arrive sometime after the confirmed arrival date or leave before the confirmed departure date.
  • The failure or inability of an entity, person, or group to obtain transport or the failure or inability of their chosen transport to operate.
  • Ill health (of a non-life-threatening nature) of anyone who is part of the booking, or their immediate relative, unless a relevant medical certificate is provided.
  • Ill health or any other matter concerning anyone who is not part of the booking including pets, friends and associates.
  • Federal or State government prohibitions on travel for any reason whatsoever, including for health reasons.

Claims for Refunds

All claims must be made in writing. Cathedral Beach may, at its sole discretion, reject such claims. If accepted, in whole or part, the refund shall, at our sole discretion, be paid by way of crediting the source of the payment, be that either your bank account or credit card account, or if you paid cash, by way of cash to you.

Early Departure or Late Arrival

Guests, who leave the campground early or do not arrive on their scheduled arrival day, will not be entitled to a refund or credit. Adverse weather is not a reason for either a refund or credit.

Cathedral Beach reserves the right to allocate your booking to a third party if you do not arrive on the agreed day of check-in and you have not notified Cathedral Beach of your delay and which notification has been accepted by Cathedral Beach.

Booking confirmation and booking numbers

When you make and pay for an accommodation booking you will have your confirmation sent to you by email. In this email you will receive a booking number confirming that your camp site or cabin has been booked and paid for. We will use this number to confirm your stay in our campground.

You must bring a digital or paper copy of the confirmation or your booking number with you for presentation at Reception upon arrival. At this time, you will be issued with an access code which will give you access to the campground amenities blocks for the duration of your stay. The confirmation entitles you to a campsite or cabin for dates as printed on the confirmation. You should keep your booking number or confirmation email for the duration of your stay. It is your responsibility to keep this information safe. During your stay, you may be asked to produce a copy of your confirmation or asked for your booking number by an authorised member of Cathedral Beach.

Site Selection

For reasons beyond Cathedral Beach’s control, there is a minor chance that a site or cabin for which you have a confirmed reservation may not be available when you check in. You will not otherwise be denied a site or cabin unless there is a valid reason, or Cathedral Beach deem them to be unsuitable for safety reasons.

In the unlikely event that Cathedral Beach is unable to provide the agreed site or cabin on the date listed on your booking confirmation documents, you will be offered an alternative site or cabin, or alternate dates. If we are unable to make suitable arrangements for alternate sites or accommodation or dates, you may be offered a full or part refund in recognition of the change to your booking. See the Refunds section above for full details.

Fires and fireworks

Campfires are not permitted without the express authority of Cathedral Beach, which authority may at the sole discretion of Cathedral Beach be declined without reason, and when so authorised shall not occur outside of a “firepit” that shall be supplied or approved by Cathedral Beach.

Bonfires are not permitted.

The use of fireworks of any kind is not permitted.

Fines will apply for non-compliance.

Nuisance

For the duration of your stay at the campground no behaviour, by commission or omission by you or your guests, if any, shall be such as to constitute a public nuisance. Noise must be kept to a minimum at all times and cease completely at 10pm sharp.

Generators with a capacity exceeding 2.0Kva or those producing noise exceeding 65 decibels shall not be used. Generators that are otherwise compliant shall not be operated prior to 9am or after 8pm.

The use of chainsaws is expressly forbidden.

Care

All campground facilities and or equipment must be left in a clean and undamaged condition after use by you or your companions. If such facilities or equipment have to be repaired or cleaned as a result of your actions or inactions, you shall be responsible for all costs associated with cleaning, repairing or replacing such facilities or equipment.

Termination

Cathedral Beach may terminate your reservation without notice in the event that it considers that you have failed to comply with any obligation imposed upon you hereunder. Once terminated, you agree to vacate your site or cabin as the case may be no later than the deadline then imposed by Cathedral Beach. Termination shall result in the immediate forfeiture of any fees paid by you.

Unaccompanied Minors

All guests under the age of 18 must be accompanied by a responsible adult such as a parent, step-parent, guardian or other adult who has parental rights and responsibilities for the under 18-year-old guest.

If a guest is found to be a person under the age of 18 who is not accompanied by a responsible adult, Cathedral Beach may immediately cancel the guest’s booking and the full booking amount will be forfeited to Cathedral Beach.

Evacuation Plan

Please ensure that you familiarise yourself with the evacuation plan for our campground in case of an emergency. A copy of the evacuation plan is located in the cabins, camp kitchens, amenities and offices of the campground.

In case of emergency, please remain calm and follow instruction from staff.

Liability

By agreeing to stay on our sites you acknowledge that you accept, for the duration of your reservation, exclusive responsibility for:

  1. any and all of your and your guests’ (if any), vehicles, trailers, belongings generally including money, valuables, food, beverages and equipment that are brought into the campground; and
  2. all of your actions and inactions and those of your guests, if any, with regard to same.

You hereby agree that Cathedral Beach accepts no responsibility for any loss or damage or theft of any property that may occur at the campground and you hereby indemnify and forever hold harmless Cathedral Beach against all claims that may be made against it by you and or any third parties with regard to same.

You hereby agree that Cathedral Beach accepts no responsibility for any personal injury or property damage, howsoever arising including viewing and traversing our campground, using its infrastructure and amenities generally including but not limited to shop, cafe, refuelling facilities, camp kitchens, BBQs, showers and toilets, and or the consumption of power or water provided on site, suffered by you or your guests during your stay at the campground and you hereby indemnify and forever hold harmless Cathedral Beach against all claims that may be made against it by you and or any third parties with regard to same.

By booking with Cathedral Beach you accept these terms and conditions and you, in your own right and or in the capacity of parent or guardian of minors in your charge, assume all risk, accept all responsibility and waive all claims for personal injury or death to you or those in your charge or damage to, theft or loss of, personal property in your custody or control or the control of those associated with you, relating to your presence on our campground and or use of its infrastructure or power or water.

You hereby indemnify Cathedral Beach and all of its employees and agents and forever hold them harmless against all claims that may be brought against it by you or any third party.

You understand and confirm that you, and those in your custody or control, have given up considerable future legal rights. You confirm that you are 18 years of age or older and mentally competent to enter into these terms and conditions.

Responsibility

Cathedral Beach may sometimes include third party products in packages we offer. As an agent on behalf of this product or service, Cathedral Beach shall not be liable under any circumstances, for any failure by those service providers to fulfil such arrangements, nor for any error, alteration or change of any kind made by those service providers following the acceptance of the booking by them. All coupons, vouchers, receipts and tickets are issued subject to the terms and conditions specified by those service providers.

Cathedral Beach will provide services with reasonable care and skill. Cathedral Beach, both for itself and on behalf of its employees or agents, does not accept any responsibility for any act, omission, default or neglect by itself, its employees or agents for injury, damage, or loss to persons or goods whatsoever or however the same may be caused and it does not warrant and is in no way responsible for the accuracy of any information given in statements made by it or its service providers in terms of accommodation & service arrangements. By utilising the services provided by Cathedral Beach, you agree that:

  1. Cathedral Beach shall not be liable for the wilful or negligent acts and or omissions of such carriers and or service providers.
  2. Cathedral Beach will not be liable for any accident, injury, delay, property damage or personal loss to you or those travelling with you in connection with any accommodation, transportation, or other travel services resulting directly or indirectly from any occurrences or conditions beyond its control, including but not limited to acts of terrorism, acts of god, defects in vehicles,

war, strikes, theft, delay, cancellation, civil disorder, disaster, government regulations or changes in itinerary or schedule.
